1 GENERAL PROVISIONS 

1.1 This document defines the terms, conditions and scope of using the mobile application “Support in Gdańsk” intended for mobile devices with the Android and iOS operating systems (hereinafter referred to as: “Application”) and constitutes terms and conditions within the meaning of Art. 8 of the Act of 18 July 2002 on Providing Services by Electronic Means 

1.2 The owner and operator of the Application, as well as the service provider of the services provided through it, is Fundacja Oparcia Społecznego Aleksandry FOSA with its registered office in Gdańsk at ul. Fryderyka Chopina 42, 80-268, KRS: 0000298471, hereinafter referred to as “Operator”. 

1.3 The User of the Application within the meaning of this document is a natural person who uses the functionalities offered by the Application through the Application installed on his own mobile device, hereinafter referred to as: “User”. 

1.4 Services provided through the Application: 

1.4.1 New Messages. The module allows you to read new messages in the fields of supporting people with mental disorders and supporting people experiencing discrimination.  

1.4.2 Booking a meeting. The functionality allows the application to sign up for a meeting with consultants of Information and Consultation Point (PIK) and Gdansk Center for Equal Treatment (GCRT). It is required to provide telephone number in order to be contacted by a consultant. The reservation is approved by the application operator. 

1.4.3 Support the FOSA Foundation – this functionality displays information about the possibility of donating 1% to a non-profit organization, i.e. the FOSA Foundation. 

1.4.4 Information and Consultation Point: Institution search engine. A search engine for support institutions, which enables the User to independently search for support in the area of mental health in the city of Gdańsk.  

1.4.5 Information and Consultation Point: Trainings. Functionality that enables the use of 7-day trainings aimed at a chosen psychological/social skill in the field of mental health.  

1.4.6 Information and Consultation Point: Contact with a consultant. The functionality enables telephone contact with a consultant by launching the default application for making telephone and video calls (Skype, Duo).  

1.4.7 Information and Consultation Point: learn more about PIK. The functionality allows the User to familiarize themselves with the activities of the project.  

1.4.8 Gdańsk Equal Treatment Center: Report unequal treatment. The User may send an initial notification of breach in equal treatment via e-mail.  

1.4.9 Gdańsk Equal Treatment Center: Connection with a consultant. The functionality enables telephone contact with a consultant by launching the default application for making telephone and video calls (Skype, Duo). 

1.4.10 Gdańsk Equal Treatment Center: Frequently Asked Questions. The functionality allows you to familiarize yourself with the most frequently asked questions addressed to the GCRT (Gdansk Centre for Equal Treatment).  

1.4.10 Gdańsk Equal Treatment Center: Quiz. The functionality allows the user to perform tasks assessing their awareness of equal treatment and non-discriminatory behaviour and attitude.  

1.4.11 Gdańsk Equal Treatment Center: Learn more about GCRT. The functionality allows the User to familiarize themselves with the activities of the project. 

1.5 The application can be downloaded from the online application store: Google Play and iStore  

1.6 Before using the Application, the User is obliged to read the Terms and Conditions and the Privacy Policy and to accept them. 

1.7 The User consents to processing of personal data by the Operator during the registration process contained in the registration form in the Application, in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as GDPR). 

1.8 Downloading the Application from the store indicated in point 1.5 of the Terms and Conditions, as well as the use of the basic services offered through it is free of charge.  

1.9 The costs of data transmission required to download, install, run and use the Application are covered by the Users on their own, on the basis of contracts concluded with telecommunications operators or other internet service providers. 

1.10 The Application is subject to the exclusive rights of the Operator and its partners and is protected by law. 

  1. The User shall be liable for providing false personal data. 

2 TECHNICAL REQUIREMENTS AND ACCESSING THE APPLICATION 

2.1 The application is available to all persons using mobile devices meeting the technical requirements and for which the above-mentioned persons will download the Application from the appropriate application store and start it properly. 

2.2 The User’s mobile device on which the Application is to be launched should meet the technical requirements for the operating system described in the store appropriate for a given operating system. 

2.3 In order for the Application to run and work properly, it is necessary to activate the internet connection function by the mobile or Wi-Fi operator. 

2.4 In order to use the full functionality of the Application, the User is obliged to register an account in the Application. 

3 USER REGISTRATION 

3.1 When using the application, in order to run the full functionality of the application, the User should complete the registration process in the Application, by means of setting up an individual User account, hereinafter referred to as “Registration”. 

3.2 In order to register, the User must provide: 

3.2.4 e-mail address; 

3.2.5 password; 

3.2.6 repeated password; 

3.2.8 confirmation by the User that they have read the Terms and Conditions and accept their content. 

3.3 After registration, a confirmation e-mail will be sent to the e-mail address provided by the User during Registration.  

3.4 Launching and logging into the Application (or having the Application running in the background) is necessary to use the Device and the functionality of the Application. 

3.5 The User has the right to delete their data provided during Registration and to change the password set during Registration. Data editing, deletion and password change is possible via the Application. 

3.6 During Registration, as well as while using the Application, the User obliged to keep the password to the Application secret and not to disclose it to other parties. 

3.7 The User bears sole responsibility for the disclosure of their password to the Application to third parties. 

3.8 The Operator informs that they do not verify the identity of Users during their Registration.  

4 USING THE APPLICATION 

4.1 Users are required to use the Application in accordance with applicable law, the Terms and Conditions and regulations of the “Play” and “iStore” application stores, as well as the principles of social coexistence, including the general principles of using the Internet and mobile applications. 

4.2 Users are obliged to use the Application and the Device in a non-inconvenient manner, respecting the personal rights of third parties and any other rights those parties are entitled to; 

4.3 Users are obliged to notify the Operator of any violation of their rights in connection with the use of the Application. 

5 OPERATOR LIABILITY 

5.1 The Operator supervises the technical functioning of the Application on an ongoing basis and ensures its correct functioning. 

5.2 The User is obliged to ensure the proper functioning of the Application to the extent that it is dependent on the User. Operators and providers are responsible for the operation of services other than the Application. 

6 TERMINATION OF USE OF THE APPLICATION AND DATA DELETION 

6.1 Users may stop using the Application at any time. In particular, when they do not accept the changes introduced in the Terms and Conditions. Removal of the Application from the mobile device is regarded as cessation of using the Application. Removing the Application from the mobile device is not tantamount to deleting the User’s account.  

6.2 In order to delete their personal data, the User may use the option “Delete Data” available in the Application in the “user profile” panel, which will delete the data; 

In any case, the User may also send a request to delete personal data to the e-mail address: aplikacja@fundacjafosa.pl.  

6.3 If it is found that the User is committing activities prohibited by law, the Terms and Conditions, violating the principles of social coexistence, harming the good name of the Operator, the Operator may take all actions permissible by law against the User.  

7 PRIVACY AND CONFIDENTIALITY 

7.1 The administrator of personal data is the Operator – Fundacja Oparcia Społecznego Aleksandry FOSA. Detailed data on the Administrator, the Data Protection Officer and on the rules of protecting the personal data of the Users of the Application are included in the Privacy Policy.  

8 COMPLAINTS 

8.1 Complaints related to the use of the Application and difficulties with the provision of services through it, as well as questions should be directed to the Operator by e-mail to the following e-mail address aplikacja@fundacjafosa.pl.  

8.2 The complaint should contain: name, surname, telephone number, e-mail address, information about the current version of the operating system installed on the mobile device and a description of the complaint. 

8.3 Within 14 days from the date of receipt of the complaint, the Operator will review the complaint and inform the User via e-mail about the outcome. The time for providing additional explanations by the User at the Operator’s request extends the period of reviewing the complaint. 

9 FINAL PROVISIONS 

9.1 In situations not regulated by the Terms and Conditions, the provisions of generally applicable law shall apply, with particular emphasis on the Polish Civil Code and the Act on the Provision of Electronic Services. 

9.2 Any disputes regarding or resulting from the use of the Services by the User shall be settled by the court competent for the seat of the Operator. 

9.3 The Terms and Conditions are available via the Application and on the website dedicated to the application – www.appfosa.pl. 

9.4 The Operator reserves the right to amend the Terms and Conditions at any time. Users will be informed about changes to the Terms and Conditions when the Application is first launched after the changes have been made. Amendments to the regulations are considered accepted by the User at the moment of their further use of the Application after the amendments come into force. 

9.5 The Terms and Conditions enter into force on December 1, 2020.
